Accutane, a Vitamin A retinoid orally ingested drug, was developed by Hoffman-LaRoche for the treatment of severe acne conditions. Because it was very effective in treating outbreaks in a matter of three to four months, it was widely prescribed and used by many with excellent results. It served to alleviate the acne outbreaks for as long as two years when it often became necessary to start its use again. Even for less severe acne conditions, the Accutane treatment was also prescribed for much milder conditions so the numbers of people who have used the drug is in the tens of millions.

Accutane Lawsuits

There have been numerous lawsuits filed against the manufacturer and the doctors who prescribed the drug due to their failure to provide adequate information about Accutane’s contraindications. These ill effects include rheumatoid pain, suicidal ideations, aberrant behavior, Cohn’s disease, liver damage, and a host of other serious side effects resulting in irreparable injury and death.

FDA Warnings and Action

By the time the FDA issued a black box warning for Accutane, millions were already adversely affected. Scores of pregnant women had miscarried, and those who did bring their pregnancies to term often had babies born with severe birth defects. Accutane has been prescribed under a host of other names including its generic name, Isotretinoin. If any pregnant patients were prescribed these drugs without signing a waiver that they were aware of the possible complications, the women may have legal recourse. Anytime a patient is not forewarned about the risks involved in taking a medication, the doctor who prescribes the drug without properly apprising the patient of those risks is responsible for the damages incurred due to the physician's negligence to inform. Hoffman-LaRoche stopped its manufacture of the drug in 2009, claiming that its market share for the once one of three most popular drugs it produced, plummeted to an all time low. Since its inception in 1982, however, 13 million people worldwide have been treated with this sometimes deadly prescription.
